Under Florida Statutes, family or household members involved in domestic violence refer to many types of relationships:

  • Persons residing together or who have resided together as in a family (partners, friends and acquaintances)

Domestic violence under Florida law covers a variety of violent behavior between family or household members:

In appealing the case of Rey v. Perez-Gurri, 662 So.2d 1328 (fla. 3rd DCA 1995) Carmen M. Morales established a precedent in Florida case law that a woman does not have to become a victim of domestic violence to acquire an injunction, but merely has to show reasonable cause to fear domestic violence will occur.

Our firm also helps victims of domestic violence to file domestic torts to sue the abusive family or household member for compensation to pay for medical bills, lost wages, and pain and suffering.

When defending against alleged domestic violence charges, we aggressively investigate all aspects of a claim to see if it is based on falsehood in an attempt to influence child custody, or visitation rights, or win favor in a divorce. If a permanent injunction has been entered that prohibits or limits visitation, we work to reduce its effects so our client may be actively involved in his or her children’s lives.
