Divorce
Even though marriages begin with hopes of a bright future, when a marital relationship becomes unbearable, divorce may be the only answer. The Miami law firm of Carmen M. Morales, P.A. assists clients throughout South Florida to file for divorce as well as resolve the complex issues that divorce often encompasses.
No-fault Divorce
Florida is a no-fault divorce state, meaning no grounds must be proven in order to obtain a divorce in Florida. There are, however, two requirements that must be met:
- 6 months residence in the State of Florida prior to filing for divorce
- Statement by one of the spouses before a judge and under oath that the marriage is irretrievably broken
For many couples, whether settling outside of court or going to trial, finalizing divorce requires establishing arrangements for:
- Parenting Plans (Custody/Visitation)
- Child support
- Marital property division
- Spousal maintenance (alimony)
Complex Divorce Issues
If one or both spouses own substantial assets, property division may be complicated. At Carmen M. Morales, P.A., through extensive experience in dealing with complex divorces, we have established a network of experts to assist our clients with:
- Appraisal of assets and real estate
- Valuation of businesses
- Corporate tax matters for jointly owned businesses
- Estate planning
- Tax issues arising from divorce
Drawing on the expertise of financial consultants, estate planners, appraisers and business valuation experts, we determine true income and equitable distribution of property, while at the same time striving to preserve assets.
Whenever possible, our firm works with clients to settle out of court through negotiation or alternative dispute resolution methods (ADR), such as collaborative family law and mediation. Carmen M. Morales is not only a Florida Board Certified Family Law Specialist, but is also a Florida Supreme Court Certified Mediator. Most cases can be resolved short of litigation, which has the advantages of saving time and expense as well avoiding exposure of private matters. However, should your case go to trial, Ms. Morales is a powerful litigator with an impressive track record of winning cases. Forensic accountants, documentation experts (for handwriting analysis), forensic psychologists, and forensic psychiatrists are at our disposal to assist as needed in analyzing evidence.
Clients look to Carmen M. Morales for her compassionate yet tough, professional manner in dealing with divorce. While representing clients throughout South Florida, she also handles clients out of state and internationally who have ties to Florida.
